Terms and Conditions
for the sale of digital GPS bike tracks via an online store (B2C)
1. Scope
These Terms and Conditions apply to all contracts entered into between

(hereinafter referred to as the “Seller”) and consumers as defined by the Consumer Protection Act (KSchG) (hereinafter referred to as the “Customer”) via the Seller’s online store.
Consumers are individuals who enter into legal transactions for purposes that are not primarily attributable to their commercial or self-employed professional activities.
2. Subject Matter of the Agreement
The subject matter of this agreement is the sale of digital GPS routes (bike tracks) made available through the Ride with GPS platform.
After completing the purchase, the customer will receive a unique code that can be used to unlock and download the route on Ride with GPS.
This refers to digital content that is not delivered on a physical medium.
3. Conclusion of the Contract
The presentation of products in the online store does not constitute a legally binding offer, but rather a non-binding invitation to place an order.
By clicking the “Buy” button, the customer submits a binding offer to enter into a purchase agreement. The agreement is concluded as soon as the seller confirms the order via email or sends the download code.
4. Prices and Payment
All prices are in euros (EUR) and include applicable sales tax, if any.
The available payment methods are displayed in the online store.
The download code will be sent or made available only after full payment has been received.
5. Delivery / Provision
Delivery is made exclusively in digital form via email.
It is the customer's responsibility to have an active user account with Ride with GPS in order to access the route.
The seller assumes no liability for technical limitations or changes on the part of the Ride with GPS platform.
6. Rights of Use
The customer is granted a simple, non-transferable, and non-exclusive right to use the purchased GPS tracks. Use is permitted solely for personal purposes.
In particular, the following is prohibited:
- share, sell, or publish the tracks
- to use the tracks for commercial purposes
- make the codes or routes publicly available
7. Right of Withdrawal
Consumers generally have a statutory right of withdrawal.
However, the customer expressly acknowledges that, with regard to digital content, the right of withdrawal pursuant to § 18(1)(11) FAGG expires if:
- the seller has begun to perform the contract and
- the customer has expressly agreed that performance of the contract may begin before the expiration of the cancellation period, and
- the customer has confirmed that this will result in the loss of their right of withdrawal.
By purchasing and receiving the download code, the customer expressly agrees to these terms.
8. Warranty and Liability
The statutory warranty provisions apply.
The seller assumes no liability for:
- the actual passability of the route
- Temporary closures, construction zones, or route changes
- weather-related restrictions
- the customer's individual riding skills or equipment
Use of the routes is at your own risk.
9. Disclaimer Regarding Content
The GPS tracks have been carefully created. However, we cannot guarantee that the routes are completely accurate, up-to-date, or safe.
To the extent permitted by law, the seller shall not be liable for any damages resulting from the use of the routes provided.
10. Privacy Policy
Information regarding the processing of personal data is set forth in the online store’s privacy policy.
11. Governing Law and Jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
For consumers, the statutory venue applies.
12. Final Provisions
If any provision of these Terms and Conditions is found to be invalid, in whole or in part, the validity of the remaining provisions shall remain unaffected.
Any changes or additions to these Terms and Conditions must be made in writing.
